Solicitation of donation from the public by a Company Limited By Guarantee

Applicant should make an application for solicitation of donation from the public by a Company Limited By Guarantee by filling out Section 45 Lodgement of Application by CLBG for Registrar’s approval (Appendix B) or Section 45 Application by CLBG for Minister’s approval (existing CLBG) (Appendix C) and attach supporting documents according to Checklist 6.

The application should be submitted to SSM counter for Minister's or Registrar's approval.

The statutory declaration by the director/trustee confirming adherence to the relevant requirements shall be prepared according to Example 5A or Example 5B.

Fee :

1. Application for Minister's approval : RM 300.00
2. Application for Registrar's approval : RM 100.00

Note :

1. CLBG incorporated for less than 1 year is not eligible to apply for this application.
2. CLBG must have at least 1 year Audited Financial Statement.
3. The approval for solicitation is only valid for one year. The CLBG is required to re-apply this application after the expired approval date.  
4. Example 5A - Application for Minister's approval; Example 5B - Application for Registrar's approval.
5. The tax exemption under subsection 44(6) of the Income Tax Act 1967 is not required to attach for this application.
6. The third-party is not allowed to collect funds on behalf of the CLBG.
