Procedures for incorporating a Company Limited By Guarantee without the word "Berhad" or "Bhd"

The procedures for incorporating a Company Limited By Guarantee(CLBG) with the word "Berhad" or "Bhd" under Section 45 Companies Act 2016 are:

1. Applicant should make an application at MyCoID and click 'Application for Reservation of Name - Optional' menu to apply for reservation of name.

2. Next, applicant should submit Section 45 Application by CLBG for Minister’s approval (Appendix A) with supporting documents according to Checklist 1 to SSM counter.

Fee :

1. Application for name reservation : RM 50.00
2. Minister's approval :
1. With the use of gazetted words : RM 700.00
2. Without the use of gazetted words : RM 400.00
3. Registration of CLBG : RM 3000.00

Note :

1. The biodata, qualification and experience in charitable activities for each proposed director and promoter has to be prepared according to format in Example 3 .
2. An estimated/forecasted income and expenditure for a period of 2 years from the establishment of the CLBG has to be prepared according to format in Example 4. The statement should show the contribution from the donor.
